Welcome to IBIDMOTO Auctions, a subsidiary of EVENTBOARD S.L.
By accessing or using this website, you agree to be bound by these Terms & Conditions. This is a legally binding agreement between you and IBIDMOTO S.L. Please read it carefully.

1. General Provisions

IBIDMOTO operates an online marketplace that facilitates private vehicle auctions between buyers and sellers. IBIDMOTO acts solely as a technical intermediary and is not a party to any contract concluded between users. IBIDMOTO does not act as a dealer, broker, or agent.

Users may report inaccurate, unlawful, or infringing content by contacting contact@ibidmoto.eu. Intellectual property owners who believe their rights have been infringed may submit a notice to the same address.

IBIDMOTO reserves the right to amend these Terms & Conditions at any time. Changes become effective upon publication. Continued use of the website constitutes acceptance of the revised terms.

IBIDMOTO may restrict, suspend, or discontinue the website or any part of it at any time without prior notice.

All content on IBIDMOTO Auctions is provided for informational purposes only. While reasonable efforts are made to ensure accuracy, IBIDMOTO does not guarantee that listings are complete, accurate, or up to date. Users must independently verify all information with the seller prior to entering into any transaction.

2. Buying and Selling Vehicles

IBIDMOTO is a marketplace service within the meaning of EU consumer protection legislation. All vehicle descriptions, images, and statements are provided solely by sellers. IBIDMOTO does not verify listings and assumes no responsibility for their accuracy, legality, or conformity.

Any transaction resulting from an auction is concluded directly between the buyer and the seller. IBIDMOTO is not responsible for vehicle condition, ownership, title transfer, payment execution, or delivery.

2.1 Seller Obligations

By listing a vehicle on IBIDMOTO Auctions, the seller confirms that:

  • They are the lawful owner or have full legal authority to sell the vehicle
  • The listing information is accurate, complete, and not misleading
  • They are prepared to sell the vehicle to the highest bidder at the final bid price
  • They can legally transfer ownership of the vehicle

Sellers must register and provide accurate identification and contact information. IBIDMOTO reserves the right to suspend or terminate access where a seller engages in misleading conduct, unfair commercial practices, or breaches these Terms.

Fees for Private Auction listings are payable regardless of whether the vehicle is sold.

2.2 Buyer Responsibilities

Buyers are responsible for conducting all necessary checks, including vehicle inspections, history checks (e.g. HPI or equivalent), and verification of ownership and documentation.

IBIDMOTO strongly recommends physical inspection prior to bidding. IBIDMOTO accepts no responsibility for defects, discrepancies, or disputes arising after the transaction.

Payments made to sellers are at the buyer’s own risk. Buyers should verify the seller’s identity and request proof of payment.

3. Consumer Rights (EU Compliance)

Nothing in these Terms & Conditions affects mandatory consumer rights under applicable EU or national law.

Where transactions take place between private individuals, statutory consumer rights such as the right of withdrawal under Directive 2011/83/EU generally do not apply. Users acknowledge that IBIDMOTO does not determine the legal status (consumer or trader) of sellers unless explicitly stated.

IBIDMOTO does not limit rights relating to unfair commercial practices, misleading advertising, or fraud under EU law.

4. Disclaimer of Warranties and Limitation of Liability

The website and services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by EU law, IBIDMOTO disclaims all warranties, express or implied, including accuracy, merchantability, fitness for a particular purpose, and non-infringement.

IBIDMOTO shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, business, or data, arising from use of the platform.

Any liability of IBIDMOTO shall be limited to the amount paid by the user for the specific service giving rise to the claim. Nothing in this clause excludes liability that cannot be excluded under applicable law.

5. Registration and Account Security

Access to Private Auctions requires registration. Users must provide accurate and complete information and must not impersonate any other person.

Users are responsible for maintaining the confidentiality of their login credentials and for all activity conducted under their account. Any suspected unauthorized access must be reported immediately to IBIDMOTO.

6. Acceptable Use and Data Protection

Users agree not to engage in spamming, data scraping, or misuse of personal data obtained through the platform.

Contact information obtained via IBIDMOTO may only be used for legitimate communication relating to the potential purchase or sale of a listed vehicle.

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and IBIDMOTO’s Privacy Policy. IBIDMOTO acts as an independent data controller for platform-related processing. Users remain responsible for lawful handling of personal data exchanged directly between buyers and sellers.

7. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of Spain.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, unless mandatory consumer protection law provides otherwise.
